Oswego Man Charged with Possessing, Disseminating Child Pornography

St. Charles, Illinois – July 30, 2025 – The Kane County State’s Attorney’s Office, in conjunction with the Kane County Sheriff’s Office, has announced the arrest and formal charges against Ethan Garcia, of Oswego, following a months-long investigation into allegations involving the possession and dissemination of child sexual abuse material (CSAM).

According to State’s Attorney Jamie L. Mosser and Sheriff Ron Hain, Garcia faces multiple serious charges related to the illegal possession and sharing of explicit materials involving minors. The specific charges are as follows:

•One count of Disseminating Child Pornography, a Class X felony

•Three counts of Disseminating Child Pornography, Class 1 felonies

•Four counts of Possessing Child Pornography, Class 2 felonies

The charges stem from events alleged to have occurred on or about February 28, 2024, during which Garcia is accused of possessing and disseminating a video and several images that depict child sexual exploitation.

Following an in-depth investigation led by the Kane County Child Exploitation Unit — a specialized task force formed in 2022 to combat sexual exploitation of children — a warrant was issued for Garcia’s arrest. He voluntarily surrendered himself to authorities at the Kane County Sheriff’s Office on July 23, 2025.

That same day, Garcia appeared before a judge for a pretrial detention hearing, during which the State’s Attorney’s Office petitioned for his detention. However, the court denied the motion, and Garcia was released under Pretrial Supervision while awaiting trial.

As part of the conditions of his release, Garcia is prohibited from:

•Having any unsupervised contact with minors

•Accessing the internet

•Using or possessing any camera or recording device

Garcia is scheduled to return to court on August 13, 2025, at 9:00 a.m. in Courtroom 211 of the Kane County Judicial Center.

About the Kane County Child Exploitation Unit

This case is the latest in a series of prosecutions by the Kane County Child Exploitation Unit, a joint initiative between the State’s Attorney’s Office and the Sheriff’s Office. Since its establishment in 2022, the unit has been instrumental in uncovering and prosecuting crimes involving the sexual exploitation of children across the county.

“We remain deeply committed to safeguarding the children of Kane County,” said State’s Attorney Mosser. “This partnership between our offices ensures that these heinous crimes are thoroughly investigated and appropriately prosecuted.”

Legal Reminder

As with all criminal cases, the charges against Ethan Garcia are allegations. He is presumed innocent until proven guilty in a court of law. It is the State’s burden to prove guilt beyond a reasonable doubt during trial.
